Has Kate Gosselin made it onto Santa's "nice" list this year, or is she about to get a Jon-sized lump of coal in her stocking? There are conflicting reports about the state of her divorce from her hubby of 10 years.

TMZ says the arbitrator in their divorce case has determined how the estranged parents of eight camera-ready kids should divvy up their money and property, making a final divorce decree "imminent."

But Jon's lawyer insists to the AP that no settlement has been reached, adding that the embattled husband and wife will likely still be married until early 2010.

According to the attorney, the arbitrator's settlement on finances and custody is "a work in progress" and the reality TV pair hasn't yet signed off on it.

Not so, a source tells Radar Online, maintaining that the soon-to-be former Mrs. Gosselin is more than pleased with the purported verdict on the division of assets.

"She couldn't be happier," says the insider of the confidential and sealed decision. "Kate is thrilled."

Meanwhile, Jon is said to be strapped for cash (hey, cigarettes and Ed Hardy T-shirts aren't cheap) after getting a legal smack-down last week from TLC, the network behind "Jon & Kate Plus 8." He's currently prohibited from making public appearances or endorsing products.

"He has warned his lawyers that he can't pay them, and if he doesn't succeed against TLC, he will have no funds," a source told FoxNews.com. "He's even gone so far as to say that if they want to be paid, they will have to sue him."
