Hearing still on for reporter in Colo. shootings
DENVER (AP) — A squabble between prosecutors and defense lawyers in the Colorado theater shootings won't delay a hearing to question a New York-based reporter about her confidential sources for a story about the suspect.
In an order made public Friday, the judge said the hearing for Fox News reporter Jana Winter will go ahead Monday as planned.
Winter cited unnamed law-enforcement officials as saying James Holmes sent a psychiatrist drawings that foreshadowed the July shootings, which killed 12 and injured 70.
Holmes' lawyers say the leak violated a gag order. They want to know Winter's sources.
Prosecutors asked the judge to dismiss the defense complaint and cancel Winter's appearance, alleging defense lawyers themselves violated the gag order.
The judge refused.
Separately, prosecutors will announce Monday whether they will seek the death penalty.
