District Attorney's spokeswoman Jane Robison says the attorney for the "Mean Girls" star informed the court that she would not appear on Friday. The decision means Lohan's case will now be heard by a new judge who will convene a hearing in April to determine if there is enough evidence for the actress to stand trial.
Wednesday was the deadline for Lohan to tell Los Angeles Superior Court Judge Keith Schwartz whether she would agree to plead no contest or guilty to taking a $2,500 necklace from a jewelry store in January.
Lohan has pleaded not guilty and denied wrongdoing.
