Imprisoned "Real Housewives of Atlanta" star Apollo Nida has filed to divorce Phaedra Parks from behind bars.
The filing comes a month after Phaedra claimed that she was already divorced, but there is a question as to whether that is true. While multiple media outlets have reported over the last year that they are split, no one has actually seen documentation.
Apollo is now making it official. According to TMZ, the former reality TV star filed his divorce petition in Georgia on Dec. 1. In his filing, he requested joint legal custody of their two children -- Dylan, 3, and Ayden, 6 -- and an equitable split of their assets.
Apollo listed the separation date as June 2014, but he makes no mention of his current address, FCI Fort Dix correctional facility in New Jersey, where he will be until 2020, following an eight-year sentence for fraud charges.
In the docs, he says his and Phaedra's marriage is "irretrievably broken."
The filing comes less than a month after reports surfaced that Apollo is engaged to another woman.
According to TMZ, Apollo and his fiancée have been dating for two years, and she "does appear on ['Real Housewives of Atlanta'] later in the season at one of the cast events."
She and Apollo have reportedly both shot scenes for the upcoming "Housewives" season. In the scene, he's on the phone from prison, so only his voice is heard. Producers of the show have desperately tried to keep the fiancée's identity under wraps until the episode airs, but media sleuths uncovered her identity shortly after the reports surfaced.
On a recent episode of "Housewives," Phaedra spoke to co-star Porsha Williams about her split with Apollo. Again, she claims she filed paperwork.
"I filed for divorce last year, and it has been a long, drawn-out process because Apollo has not wanted to get the divorce," she said. "I'm waiting for word on my divorce being final. I'm just hoping that we can get this resolved."
The duo married in 2009.
