Bethenny Frankel has just begun the process of divvying up her $55 million fortune with ex, Jason Hoppy, and the judge presiding over the case is already skeptical of the Skinnygirl maven's homefront tactics.

During an appearance in Manhattan Supreme Court on Thursday, Justice Ellen Gesmer sounded off on a photo that made headlines recently, ordering Frankel's lawyer, Allan Mayefsky, to have his client adhere to a new rule: "No more pajamas!"

Gesmer was referring to an Instagram photo Frankel posted in July that showed her wearing her 4-year-old daughter, Bryn's Hello Kittie P.J.'s. The image spawned a slew of online criticism as commenters worried about the effect Frankel's move could have on her daughter's self image and body image.

Us reports that in court, Mayefsky defended the photo in much the same way Frankel did this summer, assuring the judge it was a joke.

"It's not a joke," Gesmer retorted. "Her child is not a joke."

Frankel, whose talk show was canceled in Frebruary, is slated to return to TV in the next season of "The Real Housewives of New York City," according to Us.
