In a 6-3 decision, the court's majority argued that DOGE staff may need access to these records in order to carry out their duties."We conclude that, under the present circumstances, SSA may proceed to afford members of the SSA DOGE Team access to the agency records in question in order for those members to do their work," the majority opinion read.
The justices emphasized that their ruling factored in several considerations — including the public interest, whether the administration would face harm without a stay and if other parties would be negatively impacted in the proceedings.

However, not every justice was on board with this decision.The high court's three liberal justices — Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson — opposed the majority ruling.
"The Government wants to give DOGE unfettered access to this personal, non-anonymized information right now — before the courts have time to assess whether DOGE's access is lawful," Jackson and Sotomayor wrote.
"In essence, the 'urgency' underlying the Government's stay application is the mere fact that it cannot be bothered to wait for the litigation process to play out before proceeding as it wishes," they added.

The Social Security Administration holds sensitive information including Social Security numbers, medical records, birth certificates, banking information, income history and tax records.President Donald Trump's administration claims that DOGE needs access to that private information to get rid of "waste" and "fraud" in the federal government.
White House spokesperson Elizabeth Huston reportedly said in a statement that the court's findings will allow the administration to "carry out commonsense efforts to eliminate waste, fraud and abuse and modernize government information systems."
