The man, referred to as O.C.G. in court documents, is now set to receive due process in the United States. According to his attorney, Trina Realmuto, he is expected to remain at an immigration facility in Arizona.There, he will await immigration proceedings ordered by U.S. District Judge Briant Murphy.
The Department of Homeland Security announced last week that plans were underway to bring him back. According to The New York Times, O.C.G. has since returned to the U.S.

In February, an immigration judge blocked O.C.G.'s deportation to Guatemala, citing his fear of persecution in his home country.As part of a class action lawsuit, the Guatemalan national claimed immigration officials never asked if he feared persecution in Mexico. He alleged that he was assaulted and targeted for being gay while in the country.
With no other option, O.C.G. accepted Mexico's offer to deport him to Guatemala, where he says he's been living in hiding.

At first, President Donald Trump's administration disputed O.C.G.'s claims, citing a sworn statement from an Immigration and Customs Enforcement official who said O.C.G. was given a chance to voice any concerns about being deported to Mexico.However, officials later walked back that statement, admitting it was based on an inaccurate note in the ICE database.
Judge Briant Murphy then ordered the Department of Homeland Security to arrange for O.C.G.'s return to the United States.
