The U.S. Court of Appeals for the 9th Circuit issued the administrative stay after Donald Trump issued an emergency appeal. This will allow the Republican leader's activation of the California National Guard to stay in place until Tuesday, June 17. On the same day, a panel will discuss the matter and come to a final decision. The current members of the appeals court consist of two Trump-backed judges and one appointed by former President Joe Biden.

After California Governor Gavin Newsom filed a lawsuit against Donald Trump and his administration for sending in the troops, San Francisco U.S. District Judge Charles Breyer allowed the left-leaning politician to retake control of the National Guard members sent to Los Angeles on Friday, June 6."At this early stage of the proceedings, the Court must determine whether the President followed the congressionally mandated procedure for his actions. He did not," the legal authority wrote in the ruling. "His actions were illegal — both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. He must therefore return control of the California National Guard to the Governor of the State of California forthwith. That's the difference between a constitutional government and King George."
Breyer's order stayed in place until 3 p.m. on Friday, June 13.

On Tuesday, June 10, California Governor Gavin Newsom slammed Donald Trump for his "brazen abuse of power" by ordering troops into the West Coast state."This brazen abuse of power by a sitting president inflamed a combustible situation, putting our people, our officers and even our National Guard at risk," the Democrat explained during a meeting with the press. "That's when the downward spiral began. He doubled down on his dangerous National Guard deployment by fanning the flames even harder. And the president, he did it on purpose."
Following Judge Charles Breyer's original ruling on Thursday, June 12, Newsom stated, "Donald Trump better abide by these orders or we have a constitutional crisis the likes of which we haven't seen in our lifetime."
